Sports Circle Indemnity Policy

01Purpose

This policy sets out how members, guests, players and website users agree to indemnify, defend and hold harmless Sports Circle, its management, employees, affiliates and partners against claims, losses, damages or liabilities connected with their use of the venue, services or website.

02Scope

It applies to visitors and players, members and pay-and-play users, tournament or event participants, website users, online registrants, social-media users and parents or guardians of minor participants.

03Acknowledgement of risk

Sports participation involves inherent risks including physical injury, illness, accident, equipment misuse, weather hazards, third-party negligence and unforeseen conditions. By using the facilities or joining an activity, you accept responsibility for your participation and personal injury, property damage or loss, subject to rights that cannot lawfully be waived.

04General indemnification

You agree to indemnify, defend and hold harmless Sports Circle, its management, employees, coaches, vendors, contractors and affiliates against claims, demands, damages, costs or liabilities, including reasonable legal expenses, arising from:

• Injury, illness or death resulting from your participation
• Damage or loss to personal property while using the facilities
• Your negligence, misconduct or breach of rules
• Violation of these Terms or applicable law
• Misuse of the facilities, website or digital platforms
• Use of a third-party link, service or product

This obligation applies to your acts, omissions, negligence and participation.

05Website indemnity

Sports Circle is not responsible for technical errors, data breaches or third-party attacks beyond its reasonable control, user-posted content, external links or loss caused by reliance on website information. You agree to indemnify Sports Circle for misuse, hacking attempts or unauthorised activity through your device or account.

06Participation waiver

Before participating, each person confirms that they are fit to participate or have obtained appropriate medical advice, understand the activity and its risks, voluntarily accept those risks and will follow safety rules and staff instructions. A parent or guardian must provide consent for a minor and accepts responsibility on the minor’s behalf.

07Medical emergencies

Staff may provide reasonable first aid or arrange medical attention at their discretion. The participant is responsible for related medical costs and agrees not to hold Sports Circle liable for an outcome except to the extent liability cannot lawfully be excluded.

08Property damage and misconduct

Users are responsible for damage they cause to Sports Circle property, equipment or infrastructure, whether deliberate or accidental. Violent behaviour, harassment, serious misconduct or rule violations may result in termination of access and lawful action.

09Third-party events and vendors

Sessions involving external coaches, trainers or event organisers are undertaken at the participant’s risk. Sports Circle is not liable for disputes or injury arising solely between a user and a third-party vendor.

10Limitation of liability

To the fullest extent permitted by law, Sports Circle is not liable for direct, indirect, incidental or consequential damages arising from use of the venue or website. Aggregate liability will not exceed the amount paid for the specific service in question.

11Force majeure

Sports Circle is not responsible for delay, cancellation or damage caused by events beyond reasonable control, including natural disasters, equipment failure, power outages, pandemics, government restrictions or unforeseen technical disruption.

12Legal standing and acceptance

This policy is governed by the laws of India and disputes are subject to the courts having jurisdiction in Jamshedpur, Jharkhand. By entering the premises, making a booking, joining an activity or using the website, you acknowledge that you have read, understood and voluntarily agreed to this policy.
